Millcreek Memories, Inc. d/b/a Millcreek Memories (“Millcreek” or “we”) provides a unique mixture of services and products through saving your most precious memories by providing instant access to images, videos, or audio files through unique QR codes embedded in your choice of jewelry or other items for sale on their website (the “Services”). Inherent in the Services is the collection and processing of your Personal Information. This Privacy Policy address our treatment of Personal Information. (1) TYPES OF PERSONAL INFORMATION WE COLLECT
Information You Provide To Us

When you create an account, you provide us with Personal Information such as:

      1. Personal identifiers, contacts, and characteristics (for example: name and contact information)
      2. Billing information
      3. Any videos, images, or audio that you upload to the Millcreek system

As you use Millcreek’s Services, including our website, we may collect other information to help serve you better, such as:

      1. Session and device information

(2) HOW WE PROCESS PERSONAL INFORMATION

Millcreek uses Personal Information to deliver the Services, and also to improve the Services and to communicate with you about the Services, including marketing communications.

The main ways that we use the Personal Information that you provide to us or that we collect when you use the Service are:

      • To provide our Services: when you upload your image/video/audio file, we process this information to deliver your order to you;
      • to manage your account and billing, including for technical support;
      • to prevent, detect, and investigate potentially prohibited or illegal activities, including fraud and violations of our Terms of Service; and
      • to improve Millcreek’s products and services.

Prior to sending you the final product, we will scan and access your original image, video, or audio file to ensure that the corresponding QR code functions correctly (“Quality Control Review”). Other than this Quality Control Review, Millcreek will not access the control of the original image, video, or audio file. 

We may communicate with you if you’ve provided us the means to do so. For example, if you’ve given us your email address, we may email you about your use of the Services. Also, we may receive a confirmation when you open an email from us. This confirmation helps us make our communications with you more applicable and improve our services. If you do not want to receive communications from us, you can always opt out by unsubscribing through the link at the bottom of our emails. 

We do not use Personal Information to make automated decisions and we do not sell any personal information that we collect.

(3) TRANSFER OF INFORMATION TO A THIRD PARTY
      1. Millcreek will not sell or share your personal information with any third party to promote sales, except to the company’s own business partners, or if you have specifically permitted us to do so.
      2. We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide the Services to you. For example, we use a payment processing service to receive and process your credit card transactions for us. Our agents do not have any right to use the Personal Information we share with them beyond what is necessary to assist us and may not use such information for marketing purposes. We may authorize access to your data for those employees, contractors, partners, and agents who need to know that information in order to operate, develop and improve products and services.
(4) YOUR DATA PROTECTION RIGHTS
      1. Under certain privacy and consumer protection laws, you have the following rights, among others
          1. Your right of access – the right to ask us for copies of your personal information
          2. Your right of rectification – the right to ask us to correct personal information that you believe is inaccurate, you also have the right to ask us to complete information that you believe is incomplete
          3. Your right to erasure – the right to ask us to erase your personal data in certain circumstances
          4. Your right to restriction of processing – the right to object the processing of data in certain circumstances
          5. Your right to data portability – the right to request that we disclose the personal data you provide us to another organisation or to you in certain circumstances
      2. You do not have to pay any fees to exercise your rights.
      3. If you make a request, we have one month to respond to you.
      4. If you have concerns about our use of your personal information or wish to make a complaint, please use the information provided in Contact Us above.
      5. Transaction policy- We do not collect, process or shop any of your personal or credit card information during the billing process itself.
(5) COOKIES
      1. Millcreek and third party service providers of tracking technologies gather non-personal information about how users enter, navigate, and leave the website and Services, the frequency and length of visits to the Services or third party websites, application or device usage data, and your product or service preference indicated by the number of times and the length of time you view a product. Millcreek gathers this data using cookies (both first party cookies, such as the Google Analytics cookie, and third-party cookies, such as the DoubleClick cookie), web beacons, tags, and other similar techniques that deliver small files to your computer and which allow these networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers.
(6) RETENTION PERIOD
      1. Millcreek’s Services are provided on a subscription basis. We will retain your personal information until:
          1. You request your information to be deleted
          2. Your subscription is terminated, either because you have proactively cancelled the subscription or due to nonpayment
          3. The discovery of any violation of the Terms and Conditions, which will result in the immediate deletion of your account.
      2. It is important to note that your personal information includes your original image, video, or audio file. When we delete your information pursuant to this retention period, we delete the original image, video, or audio file and you will no longer have access to it. We highly recommend keeping another copy of your original image, video, or audio file.
(7) HOW IS PERSONAL INFORMATION SECURED?
      1. Your account is protected by a password, and your Personal Information is encrypted using industry standard encryption. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password and/or other sign-on mechanism appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.
      2. Your personal information is stored on a private server that is managed and operated by Millcreek. Millcreek uses industry standard security protocols for protecting its server.
      3. We endeavor to protect the privacy of your account and other Personal Information we hold in our records, but unfortunately, we cannot guarantee complete security.
(8) LINKS TO OTHER WEBSITES
      1. Millcreek’s website may contain links to third-party websites. However, our websiteis not responsible for the privacy policies of these websites, or for any complaints related to the content of these third-party websites when you load them.
(9) HOW DO WE COMPLY WITH SPECIFIC STATE AND COUNTRY LAWS?
      1. Millcreek continuously monitors the privacy obligations of the jurisdictions in which we operate to ensure that we protect your privacy and comply with the law. Specifically
          1. Millcreek will process, retain, use, and disclose personal data only as necessary to provide the Services under the Agreement, which constitutes a business purpose. Millcreek agrees not to (a) sell (as defined by the CCPA) Customer’s personal data or Customer end users’ personal data; (b) retain, use, or disclose Customer’s personal data for any commercial purpose (as defined by the CCPA) other than providing the Services; or (c) retain, use, or disclose Customer’s personal data outside of the scope of the Agreement. Millcreek understands its obligations under the Applicable Data Protection Law and will comply with them.
          2. Millcreek certifies that its Sub-processors are Service Providers under Applicable Data Protection Law, with whom Millcreek has entered into a written contract that includes terms substantially similar to this Addendum. Millcreek conducts appropriate due diligence on its Sub-processors.
          3. Millcreek will implement and maintain reasonable security procedures and practices appropriate to the nature of the personal data it processes.
(10) CHANGES IN OUR PRIVACY POLICY
        1. The Millcreek website is required to update its privacy policy from time to time. When we make these updates, the website will notify its users directly, through the home page of our website.
